(1) No one shall be kept in preventive detention unless there is sufficient ground that there is an immediate disturbance to the sovereignty, geographical integrity or public peace and order of Nepal.
(2) According to sub-section (1), the family members or close relatives of the person under preventive detention should be immediately informed in accordance with the law. But this clause shall not apply to the citizens of enemy countries.
(3) If the preventive detention officer detains a person against the law or maliciously, such person shall be entitled to compensation according to the law.
